The Maharashtra Co-operative Societies Act, 1960, governs the registration, management, and functioning of co-operative societies in the State of Maharashtra.

Key Sections:

Section 91:

Confers jurisdiction to Co-operative Courtsto decide disputes between societies and their members, excluding the jurisdiction of ordinary civil courts.

Section 91-A:

Provides for the establishment of Co-operative Courts to handle society-related disputes.

Section 101:

Enables societies and co-operative banks to recover dues through a summary procedure by obtaining a Recovery Certificate from the Registrar, without a full-fledged civil trial

Amendments:

The 2019 State Ordinance (dated March 9, 2019) simplified the regulatory regime for housing societies, making compliance and governance easier for members.

Purpose:

To facilitate the smooth functioning, dispute resolution, and financial discipline of co-operative societies and banks within Maharashtra.
